Application of the general conditions of sale

​These general conditions of sale (CGV) are systematically sent or given to each buyer to enable them to place an order. Consequently, placing an order implies the buyer's full and unreserved acceptance of these general conditions of sale. Any contrary condition opposed by the buyer will therefore be unenforceable against the seller. Any document other than these general conditions of sale and in particular catalogs, prospectuses, advertising, has only an informative and non-contractual indicative value.

Prices and billings

Payment methods accepted: Credit/debit cards

Invoices are payable at the seller's head office, without deduction or compensation whatsoever. For invoicing to a customer domiciled in France - In application of law no. 92.1442 of 12/31/1992, products subject to consumption provided for in article 403 of the general tax code are payable thirty days from the end of the month date of delivery . No discount will be granted for early payment except in the case of prior signature between the two parties of an agreement.

Late payment penalties will be due in the event of non-payment by the due date. The rate of these penalties amounts to three times the legal interest rate; interest running from the due date until the payment date

Penalty clause

​In the event of non-payment on the agreed due date, and eight days after formal notice remains ineffective, the company reserves the right to claim from its debtor, as a penalty clause, compensation corresponding to 15% of this balance, without prejudice to late payment, legal interest, and possible legal costs. The collection company's fees will be the responsibility of the customer.

The transfer of ownership of our goods is subject to full payment of their price. Notwithstanding the preceding paragraph, the risks relating to the goods are borne by the buyer as soon as they are in his possession; the buyer therefore undertakes to take out an insurance contract guaranteeing the risks of loss, destruction or theft. of the goods designated above. In the event of resale of the goods to a third party, carried out in the normal course of the buyer's business, the latter undertakes to: - stipulate a retention of title clause for its benefit. - reserve for the seller the benefit of this clause .- pay the seller as a priority from the proceeds of the resale in the event that he comes into possession of these products. In the absence of payment of a single invoice on its contractual due date, and three days after a formal notice remains unsuccessful, restitution may be requested. In the event of refusal, the seller reserves the right to request the Court of the place of storage, ruling in summary proceedings, for the delivery of the goods, and, possibly, for the appointment of the receiver who will establish and fix the value.

In the event of difficulties in the execution or on the occasion of our agreements, all disputes, whatever the subject, will be under the exclusive jurisdiction of the Ajaccio Commercial Courts, even in the event of a contrary stipulation on the letters or invoices from our customers, as well as in the event of a warranty call or multiple defendants. In all cases, only French law will be applicable.
